Avoid the risks of Property Purchase
It is very easy whilst on Holiday in Turkey to be seduced by the sun, sea, beautiful scenery and easy going lifestyle to purchase a property on an impulse. Waiters, bar owners, restaurant owners & just about any Turkish person will be only too happy to help. They get paid an introductory commission by property owners that often is more than they earn a year so the desire to sell a property is very strong. However this will often turn out to be profitable for the waiter and costly for you. The waiter does not check properties, does not belong to reputable associations, and has no interest in after care or even whether the property is in a fit state to be sold. This is why we insist that you do not buy on impulse, but go to a reputable agent or developer in Turkey or in the UK like Aquavista Property Consultants Ltd. It does not cost you any extra, although in the long run it could save you thousands of pounds and will definitely save you from a heartbreaking experience.
- Foreign nationals can buy land or property anywhere in Turkey except in military zones
- Title Deeds: Each freehold property will have a property deed known as a tapu, the name of the present owner is written on the tapu in addition to a photograph and general information about the plot size, plan number, district town and location.
- Using a lawyer: It is possible to buy in Turkey without using a lawyer and go directly to the Land Registry Office, however we strongly recommend that you use a solicitor or lawyer familiar with Turkish property laws.
- The lawyer/solicitor will carry out all necessary checks on the property. These include, but not limited to, checking the seller of the property is the owner, checking there are no outstanding bills on the property, location checks, seek living permission and arranging electricity and water connection.
- Aegean Army Search: A military background check is made on all foreign nationals buying in Turkey. Anyone with a criminal record cannot buy property in Turkey. This process takes about three months, and once approved the TAPU will be issued.
- Land Registry: Both buyer and seller can be present to enter new details in the Registry book at the Land Registry Office. However if Power of Attorney has be given to a lawyer/solicitor, they can act on behalf of the client and will retain the TAPU until contacting the client
- Insurance of the property is the responsibility of the owner once the TAPU is in their name.
- Bank account: it is a good idea to open a Turkish bank account for payment of bills.
- Purchase Tax. A total of 3% purchase tax is paid. This is split equally between the purchaser (1.5%) and seller (1.5%).
- 0.3% annual property tax is payable to the Turkish Government
- Council tax of approximately £100 per year is paid for rubbish collection etc.
- UK Tax: Turkey has a double taxation agreement with Turkey. We advise you to consult a UK taxation specialist regarding rental income and capital gains tax (CGT)
- Will. A will is advisable for both English & Turkish law.
Beyond the price advertised with our properties, you can expect the following costs when purchasing with Aquavista:
- 1.5% Purchase Tax (Note: The buyer and seller both pay 1.5% property tax).
- 0.3% annual property tax.
- 3% purchase fee. This is a standard fee in Turkey
- £60 per year council tax for rubbish collection etc.
- £250-£500 Basic Solicitors Fees: Aquavista always recommends using a solicitor or lawyer familiar with Turkish property laws. We have names of reputable solicitors available on request.
- £100 approx. charge for translator at the Notary.
- 5% approx. allowance for good quality furnishing of new homes.
- £250 est. building and contents insurance, including earthquakes (depending on size, location, security fittings etc).
- No Charge: Aegean Army Search (military background check).
- £100 refund per person up to 2 people for travel costs if viewing exclusively with Aquavista.
- Accommodation and transfer refund in location of purchase.
- Free of charge: Aquavista services.
